The petitioner is accused in connection with Jokihat P.S. Case No. 204 of 2015, registered under Sections 302 and 120(B)/34 of the Indian Penal Code.

The prosecution case is that Md. Akhtar, son of the informant, and petitioner was doing the business of selling of meat and there was dispute in regard to the distribution of the money. On 10.07.2015, in the evening, this petitioner accompanied Md. Akhtar. Thereafter, the other F.I.R. named accused persons, came to his house and threatened him of dire consequences after searching to Md. Akhtar. On the next day, the dead body of Md. Akhtar was seen on the pitch road situated

Learned counsel appearing on behalf of the petitioner submits that, in fact, petitioner has falsely been implicated in this case merely on suspicion and in course of investigation, the Police got recorded the confessional statement of the petitioner showing his involvement in committing the murder of the deceased Md. Akhtar through knife and knife is also said to be recovered from the house of the petitioner, but it would appear from the Post-mortem report that no sharp cutting injury was found on the person of the deceased. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 204 of 2015.
