The petitioner, namely, Ravi Kumar, is in custody in Noorsarai P.S. Case No. 12 of 2015 under Sections 366A/34 of the Indian Penal Code.

According to the allegation, the informant that is mother of victim girl lodged an F.I.R. alleging that this petitioner kidnapped her minor daughter. It appears that the victim girl was recovered and her statement under Section 164 of the Cr.P.C. was recorded, wherein she has clearly stated that on 01.01.2015 while she was returning from school, this petitioner and his Behnoi took her away forcefully and brought to house at Badada and thereafter on the next date, she was brought to his sister, Priyanka Kumari, where she was kept for two days and this petitioner, Ravi Kumar

Patna High Court Cr.Misc. No.55622 of 2015 (2) dt.15-12-2015 established physical relation with the victim forcefully. Considering the nature of allegation and the statement of the victim girl, I am not inclined to grant bail to the petitioner. Accordingly, this application stands rejected.
