The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 324, 354A, 504, 506/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that on 27.05.2015 when the family members of the informant went to ease, then petitioner no. 1 Ranjeet Mehta put the flash light of torch on them and started blowing whistle. Patna High Court Cr.Misc. No.2965 of 2016 (2) dt.19-01-2016 went to made complain, then petitioner no. 3 Basudeo Mehta assaulted with sharp cutting weapon near the eye of the informant, causing injury and accused persons abused him by calling caste name.

It is submitted by the learned counsel for the petitioners that there is no specific accusation against petitioner nos. 2 and 4 and the injury has been found to be simple in nature. Moreover, the informant has retracted from the initial version and filed a petition to that effect before learned court below.

Considering the fact that specific accusation is not against petitioner nos. 2 and 4, let the above named petitioner nos. 2 and 4 be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur (Supaul) in connection with Karjain P.S. Case No. 34 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. So far as petitioner nos. 1 and 3 are concerned, let the learned court below consider the prayer for regular bail of the above named petitioner nos. 1 and 3, if they surrender before the learned court below within a period of six weeks from today in connection with Karjain P.S. Case No. 34 of 2015,
