Mr.Syed Ehteshamuddin, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 11-04-2025 Heard Learned Counsel for the petitioner, Learned A.P.P for the State and Learned Counsel for the informant who appeared suo moto.

2. The petitioner is apprehending arrest in connection with Marhaura P.S. Case No.294 of 2024, for the offence punishable under Sections 341, 323, 324, 307, 379, 337, 354, 338, 504, 325, 506 and 34 of the IPC.

3. As per the prosecution, the FIR has been lodged against 9 named accused persons including the petitioner with allegation that all accused persons armed with weapons and went to informant' house and started assaulting and caused injury to the husband of the informant and her family members.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the informant herself disclosed that there was land dispute between them. It has also been mentioned in the FIR that the informant and accused persons are pattidar

5. Counsel further submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

6. Learned Counsel for the informant vehemently opposes the prayer for bail and submits that the petitioner is named in the FIR.

7. Learned APP for the State opposes the prayer for bail of the petitioner and submits that criminal antecedent of the petitioner is clean.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Marhaura P.S. Case No.294 of 2024, subject to the following conditions as laid down under Section 438(2) of Cr.P.C.
