The petitioner is accused in connection with Gaya Rail P.S. Case No. 77 of 2016, registered under Sections 379 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, it has come that on 30.12.2015 at about 3.24 P.M, the SIM of the petitioner was used in the stolen mobile. In fact, on 30.12.2015 one person wanted to sell his mobile, thereafter, the petitioner only checked his SIM inserting in that mobile, but he did not purchase due to non-producing the paper of purchase of mobile. The petitioner has no criminal antecedent is in custody since 06.11.2016.
Patna High Court Cr.Misc. No.2464 of 2017 (2) dt.06-02-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Rail, Gaya in connection with Rail P.S. Case No. 77 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
