JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2015 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. It appears that except confessional statement of coaccused as well as criminal antecedent of the petitioner there appears only one circumstance against the petitioner that mobile location of the petitioner was found near the place of occurrence at the time of the alleged occurrence.

Learned counsel appearing on behalf of the petitioner submits that as a matter of fact the petitioner is resident of nearby village of the place of occurrence and therefore it was quite natural that tower of mobile of the petitioner was found at the place of occurrence.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.54586 of 2015 (2) dt.08-12-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Dinkar Kumar, J.M. 1st Class, Bhojpur at Ara in Dhangai P.S. Case No. 14 of 2015.
