JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 This application, for grant of anticipatory bail, arises out of Malaypur. 125/18, disclosing offences under Sections 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R is that petitioner and coaccused came in the night and fired on the son of informant causing injury in the lower part of his abdomen and, thereafter, both the persons fled away.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case as the petitioner has divorced the daughter of informant and further the second daughter of informant was having illicit relationship with other accused and and they have stated this fact in their further statement and no such occurrence in the manner as alleged by
Patna High Court CR. MISC. No.9499 of 2019(4) dt.25-04-2019 2/2 the informant has ever taken place.
Learned counsel for the State opposed the prayer for bail and submitted that the injured himself has named the petitioner as the person, who fired on him.
Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available in case diary, if possible on same day, without being prejudiced by this order.
