Seen the report submitted by the learned lower court as well as Superintendent of Police, Bhojpur at Ara, wherefrom it is evident that all the prosecution witnesses have already been examined. The case is fixed for statement of the accused on 19.09.2016 and it is expected that same might have taken place.

That being so, the ball has gone to the court of accused.

In the change scenario, I do not see it a fit case for reconsideration as a result of which prayer for bail is rejected. However, learned lower court is directed to proceed with the trial and conclude the same as early as possible. (Aditya Kumar Trivedi, J.) Prakash Narayan U T
