The petitioner is accused in connection with N.D.P.S. Case No. 56 of 2016 arising out of Chhatauni P. S. Case No. 216 of 2016 corresponding to G. R. Case No. 4519 of 2016b registered under Sections 399, 402, 120 (B)/34 of the Indian Penal Code and 20 (B)/22 of Narcotic Drugs and the Psychotropic Substance Act, 1985.

It would appear from the F.I.R. that seven persons including the petitioner were apprehended by the police but nothing was recovered from the possession of the petitioner. Further submission is that the petitioner has no criminal

Case No. 217/2016 which is instituted by the police regarding recovery of looted country made pistol of co-accused Md. Ali and Kunal Kumar @ Bambam. Further submission is that the petitioner is in custody since 05.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner namely Aditya Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, East Champaran at Motihari in connection with N.D.P.S. Case No. 56 of 2016 arising out of Chhatauni P. S. Case No. 216 of 2016.. (Rajendra Kumar Mishra, J) Sudha/- U T
