Petitioner is accused in connection with Chainpur P.S. Case No. 106 of 2015 registered under Section 379 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, theft motorcycle was found in Akhlashpur Bus-Stand, Bhabhua where the petitioner is said to have been apprehended by the Police. It would appear from the paragraph-32 of the cause diary that the petitioner was not found with the motorcycle, rather petitioner was apprehended nearby the motorcycle. In fact, the petitioner has gone there to catch the bus and mere on suspicion, the Police apprehended the petitioner and remanded in the present case. It is also submitted that while

Patna High Court Cr.Misc. No.54490 of 2015 (3) dt.11-01-2016 2/2 petitioner is accused in two other cases but in both cases, he is on bail. It is further submitted that petitioner is in custody since 18.06.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhabua in connection with Chainpur P.S. Case No. 106 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
