The petitioner apprehends his arrest in connection with Majhaulia P.S. Case No.248 of 2019 registered under Section 366A/34 of the Indian Penal Code.
This is the second attempt of the petitioner before this Court for grant of anticipatory bail. Earlier vide order dated 14.11.2019 passed in Cr. Misc. No.65472 of 2019, the prayer for anticipatory bail of the petitioner was rejected. The accusation is of kidnapping of daughter of the informant by Sagar Kumar and six others named in the F.I.R. including the petitioner.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.16136 of 2020(3) dt.03-11-2021 2/2 petitioner is quite innocent and has not committed any offence and falsely been implicated in this case due to dirty village politics. He further submits that the daughter of the informant left her parental house and performed marriage in temple with co-accused Sagar Kumar on her sweet will. The said Sagar Kumar has been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 24.09.2019 passed in Cr. Misc. No.60502 of 2019.
Considering the facts and circumstances of case, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected. However, the petitioner is directed to surrender before the learned Court below within six weeks from today and seek regular bail and the learned Court below would pass order on the same day considering the fact that the main accused Sagar Kumar has been granted anticipatory bail by a co-ordinate Bench of this Court.
