ANJANA MISHRA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Diary in the present case was called for, which has since been received.

The petitioner is apprehending his arrest in connection with Barh P.S. Case No. 294 of 2015, registered for offences punishable under Sections 307, 324, 326, 451, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that only general and omnibus allegations have been leveled against the petitioner. It is further submitted that the present case has been instituted against the petitioner on account of previous enmity and land dispute with respect to ancestral property. It is also submitted

Patna High Court Cr.Misc. No.1758 of 2016 (3) dt.12-02-2016 2/2 that even in the case diary, no further cogent material has come so as to pin the blame to the petitioner for the alleged occurrence. Learned counsel appearing on behalf of the State after perusal of the case diary submits that save and except general and omnibus allegation, there is no further cogent material in the case diary.

Considering the nature of allegation made against the present petitioner, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M in connection with Barh P.S. Case No. 294 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
