The petitioner is accused in connection with Katra P.S. Case No. 97 of 2016 registered under Sections 272, 273 of the Indian Penal Code and sections 47, 51, 52, 53, 54 and 57 of the Bihar Excise Act.

The accusation is of recovery of 51.840 litres of English Wine from the tempo.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is also submitted that nothing has been recovered from the conscious possession of the petitioner. Further submission is that petitioner is in custody since 12.12.2016.

Patna High Court Cr.Misc. No.1982 of 2017 (2) dt.27-01-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-1st Class, Muzaffarpur in connection with Katra P.S. Case No. 97 of 2016.
