JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 This application, for grant of anticipatory bail, arises out of Jaynagar P.S. Case No. 78 of 2014, disclosing offences under Sections 304(B)/34 of the Indian Penal Code. Petitioner happens to be devar (brother in law) of the deceased and allegation against him and others is of causing dowry death of the deceased.
Submission of learned counsel for the petitioner is that he is devar (brother in law) of the deceased and has falsely been made accused in this case. Further no specific allegation has been attributed to him and the charge-sheet has been submitted against the husband of the deceased and others and investigation against the petitioner is going on. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Madhubani, in connection with Jaynagar P.S. Case No. 78 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
