The petitioner seeks bail in a case registered under Sections 302, 120B and 34 IPC.

The petitioner is not named in the F.I.R. The informant named Chandan Ram, who is said to have fired on the chest of the deceased. The name of the petitioner figured in the confessional statements of Govind Giri and Chandan Ram. Except the confessional statements, there is no other tangible evidence to involve the petitioner in the crime. Gobind Giri has already been enlarged on bail vide order passed in Cr. Misc. No.20294 of 2013. Co-accused Manoj Giri has also been enlarged on bail vide order passed in Cr.Misc.No.19137 of 2013. The petitioner is in jail since 13.8.2014.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari,
