The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363/366A/120B of the Indian Penal Code.
The prosecution case is of abducting the minor sister of the informant. It is alleged that sister of the informant took away ornaments worth Rs.1.5 lakh and 20,000/- cash with her. It is submitted by learned counsel for the petitioner that for the occurrence of 31.12.2014, the FIR was registered on 06.04.2015. In 164 Cr. P. C. statement the victim got her age recorded as 19 years when the learned court below assessed her age as 17 years wherein she has stated that she of her own performed marriage with the petitioner and she wants to stay with her husband.
Patna High Court Cr.Misc. No.1296 of 2016 (2) dt.11-01-2016 2/2 Considering 164 Cr.P.C. statement and age of the victim girl assessed by the learned court below which is reaching towards approaching majority, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, III, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No.59/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
