JUSTICE SUDHIR SINGH ORAL ORDER 19-04-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in a case instituted for the offence under Sections 147, 148, 149, 431, 307, 353 of the Indian Penal Code as well as Section 27 of the Arms Act and Section 17 of the Criminal Amendment Act and Sections 10, 11, 13(1)A, 3(1)B of U.A.P. Act.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application.
This is the second attempt for grant of bail on behalf of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.12.2015. Charge sheet has already been submitted in the case. No specific allegation has been made
Patna High Court Cr.Misc. No.4590 of 2017 (4) dt.19-04-2017 2/2 against the petitioner. Due to political rivalry he has been implicated in the present case. There is no eye witness to the alleged occurrence.
A report was called for from the court below. It has been reported that the case is awaiting for compliance of Section 207 Cr.P.C.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati in the District of Gaya in connection with Kothi P.S. case No.20 of 2011.
