Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The present case has been registered on the basis of written report, given by local Chowkidar, who claimed that deceased was killed by petitioner and his sons and, when petitioner and his sons attempted to dispose of the dead body, the Chowkidar along with other villagers reached there and, thereafter, the bones of dead body were recovered. Petitioner happens to be father of the deceased and in course of investigation, almost all the prosecution witnesses stated
Patna High Court Cr.Misc. No.938 of 2015 (8) dt.27-10-2015 that a petty quarrel took place between deceased and her brothers as a result whereof, deceased committed suicide by hanging herself with a tree and after that, petitioner along with his sons, took the dead body for cremation. Moreover, police after due investigation, submitted charge sheet under Sections-306, 201/34 of the Indian Penal Code, which is evident from perusal of paragraph-3 of the supplementary affidavit.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Turkaulia P.S. Case No. 334 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran.
