The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 15.03.2016 passed in Cr. Misc. No. 2526 of 2016, on the ground that the petitioner is suffering in custody since 27.06.2014, other co-accused in this case have already been allowed bail, Anil Chauhdary whose prayer of bail was rejected has already been allowed bail vide Cr. Misc. No. 51167 of 2015 by order dated 20.07.2016 vide annexure-4 and as such the petitioner also deserves sympathetic consideration.
Learned APP opposes the prayer of bail by submitting that dead body of Ganesh Yadav was recovered from the room of the petitioner and he is the main accused.
In the facts and circumstances stated above, at present,
Patna High Court Cr.Misc. No.3599 of 2017 (2) dt.15-02-2017 finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, considering the period of detention of the petitioner, let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order.
