JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The application is for grant of anticipatory bail in connection with Gardanibagh P.S. Case No. 227 of 2016 registered for offences under sections 341, 323, 379, 411/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the whole prosecution case appears to be false, as it has been lodged against the petitioner on account of the fact that he tried to snatch the mobile of the informant and when the informant raised the alarm and people came there then the petitioner managed to flee to leave his motor cycle. The petitioner has clean antecedent and has falsely been implicated in this case. Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Patna High Court Cr.Misc. No.9872 of 2017 (2) dt.06-03-2017 2/2 Having heard both sides and in view of the fact that the allegation has been made against the petitioner to have snatched the mobile of the informant, this Court is not inclined to grant bail to him at this stage, however he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit, if possible on the same day, without being prejudiced by this order. Accordingly, this petition is disposed of.
