====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-06-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the complainant, despite receiving notice, chooses not to contest the case as learned counsel for the petitioner at the outset submits that he has instruction to make submission that the petitioner is ready and willing to pay the monthly maintenance of Rs.5,000/- to the complainant and the child. It is further submitted that petitioner will start paying the maintenance amount commencing from 01.07.2023 till the matter is not finally adjudicated in the trial court or a Court of competent jurisdiction does not fix the maintenance amount if any.

No.7897 of 2020(8) dt.22-06-2023 2/2 Learned counsel next submits that petitioner will try to obtain the bank account number of the complainant for making the payment of maintenance as agreed and in the event if the petitioner is not able to get the account number of the complainant then in that event in between 1st-10th of every month commencing from July, 2023, the petitioner will be sending a cheque of Rs.5,000/- per month on the address of the complainant as furnished in the complaint petition. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 110(C) of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
