The petitioner seeks bail in connection with Bagaha P.S. Case No. 412 of 2015 registered under Sections 272, 273, 414 of the Indian Penal Code and 47(a) of the Excise Act. It is contended that the petitioner has got no criminal antecedents. He has been implicated in this case due to executive arbitrariness and the administrative high-handedness of the police. Further, there is nothing in the FIR to attract the ingredients of the offence punishable under section 414 of the Indian Penal Code. It has also been contended that the petitioner

Learned counsel for the State has opposed the application for bail of the petitioner.
Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bagaha, West Champaran in connection with Bagaha P.S. Case No. 412 of 2015.
