JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is alleged that forged cheque of Rs.1,74,500/- was deposited in the account of the petitioner on 15.09.2015 and the aforesaid amount was credited in the account of the petitioner on the same day. Furthermore, it is alleged that on 22.09.2015, when petitioner went to the concerned Bank and prayed to get his account up dated, the petitioner was arrested on the accusation of producing fake cheque in his account.

The contention on behalf of the petitioner is that fact of fake cheque had already been detected on 15.09.2015 but the first information report was lodged on 22.09.2015 and as a matter of fact, it were employees of the Bank, who committed the

Patna High Court Cr.Misc. No.57092 of 2015 (2) dt.22-12-2015 2/2 aforesaid fraud.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, Patna in connection with Agamkuan P.S.
