JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Nabinagar P.S. Case No. 258 of 2019 for the offence under Sections 30(a) of Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and was not named in the FIR. In the instant case a total of 26 litres liquor was received from the auto near Nabinagar Bus Stand. Since the petitioner is owner of the auto, he has been made accused in this case. Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from his conscious possession, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two
