JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 20.9.2014 in a case registered for the offences punishable under Sections 13(f) and 47(f) of Bihar Excise Act read with section 2(d) and 3 of Bihar Excise (Mahua flower)Rules-06.
From the pick-up van 2970 Kgs of Mahua flower was recovered.
It is submitted by the learned counsel for the petitioner that petitioner is the driver of the vehicle in question though the owner of Mahua flower has been granted bail vide Cr. Misc. No. 46463 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.558 of 2015 (2) dt.08-01-2015 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, Patna in connection with Case No. 93(c-2) of 2014.
