The petitioner seeks regular bail in connection with Mohania P.S. Case No. 628 of 2018, registered for the offence punishable under Sections 395, 412 and 414 of the Indian Penal Code.

The allegation is regarding the petitioner having been apprehended by the police and one mobile phone was recovered which, according to the police, was stolen mobile. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as no Test Identification Parade has been taken place till date to connect the petitioner with the alleged crime.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua in connection with Mohania P.S.
