The petitioner is in custody in connection with Special Case No. 355 of 2019, arising out of G.R.P. Patna, Junction P.S. Case No. 9 of 2019 for the offence under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case total 11.540 liters of foreign liquor was seized. Learned counsel for the petitioner next contended that nothing was recovered from the conscious possession of the petitioner. Learned counsel for the petitioner would submit that petitioner is in custody since 09.01.2019.

No.9654 of 2019(2) dt.18-02-2019 2/2 Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to enlarge the petitioner on bail, let the petitioner named above be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No. 355 of 2019 arising out of G.R.P. Patna Junction, P.S. Case No. 09 of 2019.
