JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-07-2020 Heard learned counsel for the petitioners and learned counsel for the State via video conferencing. By way of the present application, the petitioners have sought for pre-arrest bail in connection with Tarabari P.S. Case No.10 of 2019 registered for the offences punishable under Sections 341, 323, 354B, 504 and 506 read with 34 of the Indian Penal Code.

Considering that an omnibus and general allegation has been made against altogether ten persons named in the complaint belonging to the same family and after the complaint

Patna High Court CR. MISC. No.12547 of 2020(2) dt.08-07-2020 2/2 having been sent to the police, an FIR was registered after three months as also that a plea of innocence has been taken by the petitioners and a statement has been made in para 3 that they have no criminal antecedent and having got roots in the society, they are not likely to abscond or tamper with the evidence, the petitioners are directed to be released on bail in the event of their arrest or surrender in the court below on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- V, Araria in connection with Tarabari P.S. Case No.10 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
