JUSTICE SANJAY PRIYA ORAL ORDER 21-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jhajha P.S. Case No. 105 of 2016 instituted for the offence under Section 364(A) of the Indian Penal Code.

It has been submitted that petitioner is in custody since 20.9.2016. The other co-accused has been granted bail by a coordinate Bench of this Court vide order dated 16.3.2017 passed in Cr. Misc. 3084 of 2017. The victim on his recovery has not taken the name of this petitioner in his statement before the police, recorded under Section 161 Cr. P.C.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.14631 of 2017 (2) dt.21-04-2017 amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case No. 105 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
