JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2019 Petitioner seeks bail in anticipation of her arrest in connection with Complaint Case No. 406C of 2013 lodged for the offences punishable under Sections 341, 323, 498A, 379 and 307/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be mother-in-law, is under Section 498A IPC.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against her and petitioner is mother-in-law of the complainant. Heard learned APP and learned counsel for the complainant, who has opposed the prayer for anticipatory bail of

Patna High Court CR. MISC. No.12847 of 2019(2) dt.01-03-2019 2/2 the petitioner stating that there is allegation against the petitioner also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Nalanda at Biharsharif, in connection with Complaint Case No. 406C of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
