In the instant petition, petitioner has prayed for following reliefs:- "That, this writ petitioner is being filed by the petitioner for issuance of an appropriate writ, order/orders, direction/ directions for set aside the order dated 05-05-2018 vide letter no. 1705 and 1733 passed by the Executive Engineer (Respondent no. 5) Building Construction Department, Gardanibagh Division, Patna

Patna High Court CWJC No.14831 of 2018 dt.23-03-2023 2/2 by which the contract work earlier allotted to the petitioner has been rejected without fault of the petitioner; for grant of the stay order of retender bearing no. 05 of year 2018-19 has invited by the Executive Engineer (Respondent No. 5) which is illegal, unlawful, with malafide intention arbitrary and against the natural justice."

3. There is no interim order in so far as re-tender bearing no. 05/2018-19 as on today.

4. Learned counsel for respondents submitted that re-tender has already spent its force. Therefore, the present petition does not survive for consideration. Such statement is taken on record.

5. Accordingly, the present petition stands dismissed as it has become infructuous.
