The petitioner seeks bail in connection with Vishambharpur P.S. Case No. 152 of 2024, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

Learned counsel for the petitioner submits that the petitioner was granted bail by the court below itself vide order dated 19.12.2024, subject to the condition that the petitioner would be released after the examination of the informant. It is submitted that despite the lapse of more than six months, the informant has not yet been examined, causing prejudice to the petitioner.

On the other hand, learned APP for the State opposes the prayer, contending that the present bail application is not maintainable as it is not directed against any rejection order.

After some arguments, learned counsel for the petitioner seeks permission to withdraw the present bail application, with liberty to file a modification application before the court below for modification of the bail condition. 6.

In view of the submissions, the present bail application is permitted to be withdrawn, with liberty to the petitioner to file a modification application before the court below for modification of the condition.
