On getting confidential information with regard to storage, sale of wine by Dinesh Yadav and Umesh Yadav, informant, a police personnel, along with armed police party proceeded towards their house and during course thereof, when they came near Samta School, Gausaghat, two persons seeing the police began to flee who were apprehended and, they disclosed their identity as Manoj Yadav as well as Ekbal Khan (Petitioner). It has also been disclosed that Manoj Yadav was in inebriated condition. It has also been disclosed that 400 bottles of Gaurav Saufi (Nepali wine), each containing 300ml were seized from beneath the straw. Then thereafter, it has further been disclosed

No.9630 of 2020(2) dt.06-03-2020 2/2 that as per their disclosure a pick-up van was intercepted having parked in front of house of Shailendra Yadav wherefrom wine in huge quantity, as per seizure-list, were recovered. Petitioner has got no criminal antecedent and is under custody since 01.01.2020.

In the aforesaid fact and circumstance of the case, petitioner Ekbal Khan is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 2nd-cum-Special Judge, Excise Act, Darbhanga, in connection with Sadar P.S. Case No. 545/2019, corresponding to G.O. Case No. 05/2020.
