The petitioner seeks bail in a case registered for the offence punishable under Section 364/34 of the Indian Penal Code.

The allegation is that the petitioner along with other co-accused kidnapped Santosh Kumar, son of the informant.

It is submitted that the petitioner has been falsely implicated in this case due to land dispute. Both the parties are agnates. However, the victim has been found in a Khalihan and returned on the same date of the occurrence. However, after investigation chargesheet has already been submitted against the petitioner and others. The petitioner has no criminal antecedent. The petitioner has been in custody since 26.9.2014. Considering the facts and circumstances of this case, the above-named petitioner is directed to be

No.48045 of 2014 (3) dt.23-06-2015 2 / 2 released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jamui/court concerned in Sono P.S. Case No. 36 of 2014 after framing of charge with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
