It is a case of misuse of privilege of bail. The petitioner was earlier granted bail by this Court vide order dated 29.03.2003 passed in Cr. Misc. No. 13412 of 2003. At the stage of evidence, the petitioner left pairvi and his bail bond was cancelled on 09.03.2012. Later on, he was apprehended on 06.08.2015 and since then, he is in jail. It is contended that the petitioner is ready to furnish sufficient surety to the satisfaction of the Court. Be that as it may, regard being had to the abuse of the privilege of bail for over three years, I am not inclined to
Patna High Court Cr.Misc. No.55992 of 2015 (2) dt.14-12-2015 2 / 2 grant bail to the petitioner for the present even though he is in custody since 6th August, 2015. Accordingly, the prayer for bail is rejected.
The court below is directed to expedite the trial and conclude the same as early as possible, preferably within eight months from the date of receipt/production of a copy of the order, failing which the petitioner would be at liberty to renew his prayer for bail before the Court below itself.
