The petitioner seeks bail in connection with Rajapakar P.S. Case No. 67 of 2016 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
Moni Devi, the daughter of the informant, was married to Chandan Kumar Singh, the son of the petitioner, on 24.11.2012 and after marriage the husband and other in-laws including the petitioner started demanding cash of Rs. 5,00,000/-, out of the wedlock a daughter was born and then torturous act developed more and ultimately on 19.05.2016 the petitioner informed that the daughter of the informant was killed by burning. Submission is of false implication and that the petitioner is living separately from his son Chandan Kumar Singh having no concern with him or from the deceased, without any fault the

No.2478 of 2017 (2) dt.30-01-2017 petitioner and his family members were implicated in this case, the deceased was suffering from mental disease, she was being treated at Ranchi, the petitioner being old father-in-law is suffering in custody since 22.11.2016 having no criminal antecedent and as such he deserves sympathetic consideration.
Learned APP submits that against the petitioner there is also allegation.
In the facts and circumstances stated above, considering the period of custody of the petitioner and his position, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VII, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 67 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
