2. The petitioner has preferred this application for grant of regular bail in connection with Beldaur P.S. Case No. 389 of 2024, G.R. No. 3474/2024 dated 10.11.2024 registered for the offences punishable u/ss 103(1) read with 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, the informant's sister namely Nisha Kumari was married to Chandan Singh according to Hindu rites and customs and she went to her matrimonial house. After some time, the matrimonial relationship of his sister got worst. The informant disclosed that when he went to the matrimonial house of his sister at Maheshkhunt then he was

No.11673 of 2025(2) dt.18-03-2025 2/3 informed that the informant's brother-in-law has an illicit relation with Anju Devi wife of the petitioner, Jawahar Singh who is step brother of the informant's brother-in-law. They also tried to pacify the matter but the matter could not be resolved. He also disclosed that Nisha Kumari used to protest illicit relationship of her husband. The informant also alleged that he could not contact with his sister past six months and ultimately on 10.11.2024, he received information that his sister was shot dead. Thereafter, the informant lodged the present case.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the Bhainsur of the deceased and he has no concern with the alleged offence. There is no specific allegation against the petitioner rather the specific allegation against the co-accused, Chandan Singh who happens to be the husband of the deceased and due to illicit relationship with Anju Devi, he murdered his wife under conspiracy. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 11.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Beldaur P.S. Case No. 389 of 2024, G.R. No. 3474/2024.

7. The application stands allowed.
