Informant, father of victim Marjeena Khatoon filed a written report alleging inter alia that in between the night of 16/17 January 2014, his daughter became traceless. During course of search, he came to know that Kuldeo Sharma and Ranjit Sharma, son of Bhora Sharma took her away with assistance of petitioner, Ranjit Sharma son of Sarflal Sharma.

Because of the fact that petitioner was apprehended on 14.06.14, on account thereof, in a haphazard manner the Investigating Officer submitted charge-sheet against him on 28.07.2014 without caring to trace out the victim as well as other co-accused. However, from perusal of the case diary, it is apparent that none is an eyewitness to the occurrence. Apart from the fact

No.47621 of 2014 (6) dt.24-06-2015 that the statement of mother of victim recorded under para-5 of the case diary suggests that she did not name the petitioner or his family members rather she named the family members of other coaccused who had assured her that the alleged victim along with the culprits will come in a day or two.

In the aforesaid facts and circumstances of the case, petitioner, Ranjit Sharma son of Saraf Lal Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Kadwa PS Case No. 21/2014.
