Petitioner is apprehending arrest in connection with Deepnagar P.S. Case No. 01 of 2020 for the offence under section 30(a), 32(b), 33 and 36 of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
In the instant case total 400 liters of spirit was seized from barren land near the boundary of Shailendra Mahto. Learned counsel for the petitioner submits that petitioner is neither owner of land nor the liquor. Considering the fact that the petitioner has no criminal antecedent and the land does not belong to the petitioner, the

No.9568 of 2020(2) dt.10-06-2020 2/2 Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge cum Special Judge, Excise, Nalanda at Biharsharif, in connection with Deepnagar P.S. Case No. 01 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that on release the petitioner shall render his service as volunteer in dedicated Covid-19 hospital for a period of one month. He is required to report to the district Nodal Officer who shall utilize the service of the petitioner appropriately.
