JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-08-2022 The present petition has been placed today for consideration of prayer for bail of petitioner no. 1, who apprehends her arrest in a case registered for the offence under Sections 366(A), 120(B), 379, 323 of the Indian Penal Code. The prosecution case, in brief, is that co-accused Mahaveer Kumar Das forcibly kidnapped grand daughter of the informant and in the said occurrence, he was assisted by other F.I.R. named co-accused including this petitioner. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case merely on suspicion, since she is sister of co-accused Mahaveer Kumar Das. It is further submitted that the victim girl, in her statement recorded

Patna High Court CR. MISC. No.9795 of 2022(3) dt.04-08-2022 2/2 under Section 164 Cr.P.C., has categorically stated that she was forcibly kidnapped by co-accused Mahaveer Kumar Das and in the vehicle, this petitioner was present alongwith co-accused Parmanand Das and Mahaveer Kumar Das. Petitioner is lady and has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

However, considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Vaishali at Hajipur in connection with Jandaha P.S. Case No. 18 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
