JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Chandi P.S. Case No. 217 of 2019 as well as Excise Case No. 2568 of 2019 for offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Having regard to the antecedents of the petitioner and and that recovery of country made liquor was made from house of the petitioner, this Court is not inclined to grant bail to him. The application is dismissed.

However, the petitioner shall be at liberty to surrender before the court below and pray for regular bail. On filing of the application for regular bail, the court below shall consider and
