The petitioner is accused of G.R.P.S. Case No. 51/11, Bhagalpur instituted under section 379 IPC.

According to the FIR, the constable while on duty at the railway station was confined at gunpoint and eight solar plates were stolen away by unknown criminals. The FIR was lodged against unknown. It appears from the materials on record including the impugned order that the name of the petitioner who happened to be the driver of the Sumo Victa used in the crime has surfaced on the basis of confessional statement of the co accused Mukti Das. The petitioner is in custody since 29.01.2013.

No.10603 of 2015 (2) dt.18-05-2015 2 / 2 In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in GRPS Case No. 51/11 on condition that one of the bailors shall be his own/close family member. In the event of framing of charge the petitioner shall appear in person on each date fixed at the trial. Failure in appearance on two consecutive dates shall lead to cancellation of his bail bonds.
