The petitioners are accused in connection with Sadar P.S. Case No. 370 of 2015, registered under Sections 413 and 414 of the Indian Penal Code.

The accusation is that petitioners and other were caught hold in the Tempo from which machines were recovered. Learned counsel for the petitioners submits that in fact the petitioners have no criminal antecedents and they have falsely been implicated in this case merely on suspicion due to boarding in the Tempo. The petitioners are in custody since 25.09.2015 and

Patna High Court Cr.Misc. No.55254 of 2015 (3) dt.01-02-2016 similarly situated co-accused, namely, Md. Shamshad has already been granted privilege of bail by a Bench of this Court vide order dated 11.01.2016 passed in Criminal Misc. No. 770 of 2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 370 of 2015.
