Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Special Case No.85 of 2016, arising out of Budha Colony P.S. Case No.311 of 2016, registered under Sections 20 and 22 of the N.D.P.S. Act. The accusation is that on receiving secret information about selling of the Ganja in a hut situated near the tea shop of Jogi Sao at Budh Marg, police reached there. On seeing the police, two persons started to flee away from the hut but both were apprehended, who disclosed their name as Chandraket Singh, son of Anandi Singh, and Deepak Kumar (petitioner), son of Chandraket Singh. On search of the
Patna High Court Cr.Misc. No.2362 of 2017 (2) dt.03-02-2017 2/2 hut, 35 kilograms Ganja, kept in two plastic bags, was recovered from there.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is B. Tech. in Computer Science. The petitioner being the son of the co-accused Chandraket Singh, has falsely been implicated in this case on mere suspicion and is in custody since 05.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Patna, in connection with Special Case No.85 of 2016, arising out of Budha Colony P.S. Case No.311 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
