JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and others are said to have assaulted informant with butt of three-nut and also made firing but admittedly, no one sustained firearm injury and according to the prosecution case itself, first information report was lodged on 29.04.2015 for the occurrence which had taken place on 22.4.2015. The explanation regarding the aforesaid delay has been given by the informant in his written report stating therein that on 24.04.2015, petitioner and his associates committed murder of his brother and had given threatening to him as well as his other family members.

The contention on behalf of the petitioner is that

Patna High Court Cr.Misc. No.54852 of 2015 (2) dt.09-12-2015 2/2 petitioner has already been granted privilege of bail in the case of murder of informant's brother vide order dated 14.10.2015 passed in Cr. Misc. No.39818 of 2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Sadar ( M) P.S. Case No. 143 of 2015.
