2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that on 16.04.2025 at about 08:00 A.M. while the informant was present at his house, his son Majnu Gaddi went outside along with petitioner and other accused persons. In the evening, informant came to know that all the F.I.R. named accused persons, including this petitioner, committed murder of his son and dead body of his son was found lying on the road.
4. Learned counsel appearing for the petitioner
Patna High Court CR. MISC. No.9465 of 2026(2) dt.18-02-2026 2/3 submits that petitioner is quite innocent and has committed no offence. Informant is not an eye witness to the alleged occurrence. At best, it is a case of last seen with the deceased and petitioner has falsely been implicated in this case merely on suspicion. There is no eye witness to the occurrence. It is further submitted submitted that similarly situated co-accused persons have already beeng ranted bail by this Hon'ble Court vide order dated passed in 20.11.2025 passed in Cr. Misc. No. 53479 of 2025 and order dated 24.11.2025 passed in Cr. Misc. No. 46694 of 2025. Moreover, charge-sheet has already been submitted and petitioner, having no criminal antecedents, is in custody since 18.04.2025.
5. Learned A.P.P. for the State the prayer for bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, claim based on parity, clean antecedents of the petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection
