The petitioner seeks bail in a case under Section 302/34 of the I.P.C.

The petitioner is alleged to have pierced spear in the chest of the deceased. Sudama Singh is alleged to have assaulted with spear on the thigh of the deceased.

Sri Krishna Prasad Singh, learned senior counsel for the petitioner submits that there is no specific allegation against the petitioner that he pierced spear in the chest of the deceased but during the course of investigation, the witnesses have stated that it was the petitioner who gave spear blow on the chest of the deceased Santosh Kumar Singh causing his death. Considering the facts aforesaid, I am not inclined to

Case No. 75 of 2013, pending in the court of the learned Adhoc Additional Sessions Judge-3, Bhojpur at Ara.

The Trial Court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order.
