JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioners and learned counsel representing the State.
The petitioners seek bail in connection with Bagaha P.S Case No. 380 of 2016 registered for the offences punishable under Sections 420, 379, 411 of the Indian Penal Code. Allegedly, the petitioners were caught by nearby persons and police and from possession of petitioner Shamu Ram amount of Rs. 8,000/- was recovered whereas from possession of petitioner Munna Ram amount of Rs. 6,000/- was recovered which were of the informant and Naresh.
Submission is of false implication and that after recovery of the amount which was of the petitioners, the
Patna High Court Cr.Misc. No.1813 of 2017 (2) dt.19-01-2017 2/2 informant started claiming the same in earlier he has not stated as to how much amount was stolen away and, as such, the petitioners who are suffering in custody since 10.10.2016 now deserve sympathetic consideration.
The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, considering the detention of the petitioners and nature of allegation, now the petitioners are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha P.S. Case No. 380 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
