JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Buxar Town P.S. Case No. 382 of 2016, registered under Sections 326, 302/34 and 406 of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, the police got recorded the confessional statement of named accused, Bikash Verma, who disclosed the name of petitioner along with Ajay Pandey, Jairam Paswan, Madan Paswan and Rinku Yadav. Thereafter, police apprehended the petitioner on 01.09.2016 and also got recorded his confessional statement
Patna High Court Cr.Misc. No.20058 of 2017 (2) dt.11-05-2017 showing his involvement in the present case except that there is nothing against the petitioner. It is further submitted that petitioner is accused in 18 other cases as detailed in paragraph 3 of the petition, in which, either he is on bail or he has been acquitted and in the present case, he is in custody since 02.09.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Buxar Town P.S. Case No. 382 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
