Petitioner seeks regular bail in a case registered for the offence punishable under Section 37 and other sections of the Bihar Prohibition and Excise Act and sections 272, 273, 302/34 and other sections of the IPC .

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR and his name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner claims clean antecedent. Petitioner is in custody since 31.8.2021. Investigation is complete.

Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court No.1 cum Additional Sessions Judge, Vaishali at Hajipur in Jurawanpur Police Station Case No. 73 of 2021.
